We operate this website and online store (collectively, the “Services”) to offer products and related content to you (“you,” “your,” or the “customer”). Our store is hosted by Shopify, which enables us to provide the Services.

By accessing or using the Services, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not access or use the Services.

By using the Services, you represent that you are at least the age of majority in your state or province of residence, or you have obtained parental consent to allow a minor to use the Services under your supervision.

If we cancel or modify an order, we’ll attempt to notify you via the contact information provided. Orders cannot be changed or canceled once they have entered fulfillment.

All purchases are subject to our Refund Policy. Products purchased are for personal, non-commercial use only.

5. Pricing, Billing & Payment Authorization

All prices are listed in U.S. dollars unless otherwise stated. Prices and promotions may change without notice. The price at checkout is final and includes any applicable taxes, shipping, and handling fees, unless noted otherwise.

By submitting payment information, you represent that:

  1. You are authorized to use the selected payment method;

  2. All information is accurate and complete; and

  3. You authorize us (and Shopify’s payment processors) to charge your payment method for the total amount of your order.

We are not responsible for additional bank or card fees, including currency conversion or international processing charges.

6. Shipping, Delivery & Risk of Loss

Delivery estimates are not guaranteed. Risk of loss and title transfer to you upon our delivery of products to the carrier. We are not liable for delays caused by carriers, customs, weather, or events beyond our control.

If a shipment is lost or damaged in transit, please contact the carrier directly. We may assist in submitting a claim but are not responsible for replacement until the carrier confirms loss.

7. Returns & Exchanges

Returns and exchanges are governed by our Refund Policy. Products must be unused, unopened, and returned within the timeframe specified in that policy. We reserve the right to refuse returns that do not meet these conditions or appear fraudulent.

10. Relationship with Shopify

Our Services are hosted and powered by Shopify. While Shopify enables transactions, your purchase and contractual relationship is exclusively with Kindred Naturals. Shopify is not responsible for any claims, warranties, or damages arising from your use of our Services or purchase of our products.

11. Feedback, Reviews & User Content

If you submit reviews, ideas, or feedback (“Feedback”), you grant Kindred Naturals a perpetual, worldwide, royalty-free license to use, reproduce, publish, and display such Feedback for marketing or operational purposes. You confirm you own or have the right to grant this license.

We may remove any Feedback that we deem false, unlawful, defamatory, obscene, or infringing, but are not required to do so.

12. Errors & Omissions

Occasionally, information on the Services may contain typographical errors or inaccuracies (e.g., regarding pricing or availability). We reserve the right to correct, update, or cancel orders affected by such errors without prior notice, even after an order has been submitted.

OUR MAXIMUM LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR THE PRODUCT(S) OR SERVICE(S) THAT GAVE RISE TO THE CLAIM.

You agree to indemnify, defend, and hold harmless Kindred Naturals, Shopify, and their affiliates, officers, employees, agents, and licensors from and against any claims, damages, losses, costs, or expenses (including attorneys’ fees) arising out of or related to:

  3. Your violation of any law or third-party rights.

17. Governing Law & Jurisdiction

These Terms and any dispute related to the Services are governed by the laws of the State of New York, without regard to conflict-of-law principles.

You agree that any dispute will be resolved exclusively in the state or federal courts located in Suffolk County, New York, and you consent to the personal jurisdiction of those courts.

18. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.

19. Waiver & Entire Agreement

Failure to enforce any right does not constitute a waiver. These Terms, together with our Privacy Policy and Refund Policy, form the entire agreement between you and Kindred Naturals regarding your use of the Services and supersede all prior understandings.

20. Modifications to Terms

We may update these Terms from time to time. The revised version will be posted with an updated “Effective Date.” Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

Material changes will be communicated as required by applicable law.
